Whitsunday Waste may update or revise these Terms and Conditions from time to time. Material changes, including updates to fees, services or policies, will be published on our website or otherwise communicated where reasonably practicable.

The Terms and Conditions applicable to a booking are those provided or made available to the Hirer at the time of booking, together with any subsequent changes expressly agreed to by the parties.

Changes to pricing or other material terms will not be applied retrospectively to existing confirmed bookings unless agreed with the Hirer or otherwise permitted by law.

3. BOOKING AND HIRE CONDITIONS

3.1 Bookings for delivery and/or collection of Bins may be made by telephone, email or text message to WW.

3.2 All bookings are subject to availability and confirmation by WW. Once confirmed, a booking constitutes an agreement between WW and the Hirer, subject to these Terms and Conditions and applicable consumer law.

The levy may apply to delivery, collection, exchange and other transport-related services.

The applicable fuel levy will be disclosed at the time of quotation or booking and appear as a separate line item on the invoice.

Additional fuel or transport charges arising from subsequent services will be advised where reasonably practicable before those services are provided.

At the time of booking, the non-account Customer agrees to pay:

(a) The applicable skip bin hire charge.

(b) Any applicable fuel levy or additional delivery charge.

(c) A refundable holding deposit of $400.00 towards waste disposal charges and associated costs.

Payment may be made by EFT or an approved credit or debit card.

5.2 Calculation of Final Disposal Charges

Final waste disposal charges are determined after the Bin has been collected, emptied and weighed at an approved disposal facility.

Charges are based on:

(a) The type of waste disposed of.

(b) The actual weight recorded at the facility’s weighbridge.

(c) The applicable Council or disposal facility fees.

(d) WW’s administration and processing fee of 15% of the applicable disposal facility charges.

(e) Any applicable GST, additional handling costs, contamination charges or other charges authorised under these Terms and Conditions.

5.3 Application of Holding Deposit and Refunds

Following finalisation of disposal and associated charges:

(a) The applicable disposal and associated charges will be deducted from the Customer’s $400.00 holding deposit.

(b) Where the total charges are less than the holding deposit, the unused balance will be refunded within seven (7) business days after all charges have been finalised.

(c) Refunds relating to EFT payments will be made by bank transfer to the Customer’s nominated Australian bank account.

(d) Refunds relating to card payments will ordinarily be processed to the original card or by another lawful method agreed with the Customer.

(e) The Customer agrees to provide accurate bank account details where required for a refund.

(f) Where final disposal and associated charges exceed the holding deposit, the outstanding balance will be invoiced and is payable upon receipt unless otherwise agreed in writing.

(g) Where the Customer has provided valid card payment authorisation, WW may charge amounts properly payable under these Terms and Conditions to the nominated card, within the scope of that authorisation.

5.4 Payment Processing

WW’s standard non-account pricing incorporates ordinary payment processing and administration expenses.

Customers who qualify for an advertised EFT discount will receive that discount on the applicable hire charge.

No separate card payment surcharge will be imposed.

5.5 Unpaid Charges and Recovery of Costs

The Customer remains responsible for all properly incurred and payable charges arising under this Agreement, including:

(a) Outstanding hire or disposal charges.

(b) Additional services or charges authorised under these Terms and Conditions.

(c) Loss of, or damage to, WW equipment caused by the Hirer or persons for whom the Hirer is responsible.

WW may seek payment of these amounts in accordance with the applicable payment arrangements and debt recovery provisions.

5.6 Card Payment Authorisation

Where a Customer elects to pay by card and provides a valid payment authorisation, WW may process the initial payment and any subsequently authorised charges arising from the hire.

Card details and payment information will be handled in accordance with applicable privacy and payment security requirements.

6. WASTE DISPOSAL FEES

6.1 General Disposal Charges

All waste deposited in WW skip bins is subject to applicable landfill, Council or other approved disposal facility charges.

These charges are additional to the skip bin hire fee and any applicable fuel levy.

WW applies a 15% administration and processing fee to the applicable waste disposal facility charges.

This fee covers the administrative and operational expenses associated with waste processing, including weighbridge reconciliation, invoicing, coordination, compliance, record keeping and associated handling requirements.

The administration and processing fee is separate from the skip bin hire fee and any applicable fuel levy.

GST will be applied where required by law.

6.2 Responsibility for Understanding Charges

(a) The Hirer is responsible for reviewing the applicable waste disposal charging arrangements before confirming the hire.

(b) WW can provide current Whitsunday Regional Council disposal rates upon request.

(c) Council disposal rates are published in the Council’s annual Fees and Charges Schedule and are also available from its official website.

(d) Council and other disposal facility charges may change from time to time. The applicable charges will be those in effect when the waste is disposed of, subject to any fixed price expressly agreed in writing.

6.3 Per-Tonne Charges

Waste disposal charges are generally calculated on a per-tonne basis according to waste classification, including general, green, construction and demolition, and commercial or industrial waste.

Final disposal charges are determined using the actual net weight recorded at the disposal facility’s weighbridge.

Where a facility imposes a minimum disposal charge or a separate item-specific fee, that charge will also apply.

6.4 Contaminated or Prohibited Waste

(a) If a Bin contains contaminated or prohibited materials, the Hirer is responsible for additional separation, handling, transportation, disposal or penalty charges incurred by WW.

(b) Any asbestos found in a Bin will incur a minimum additional charge of $3,000.00, together with applicable disposal, clean-up, remediation and regulatory costs, to the extent permitted by law.

(c) The Hirer must ensure waste placed in the Bin complies with all applicable environmental and waste disposal requirements.

(d) The Hirer is responsible for reasonable costs and liabilities incurred by WW arising from the Hirer’s disposal of contaminated or prohibited materials, except to the extent caused by WW’s own negligence or unlawful conduct.

6.5 Composition and Calculation of Disposal Charges

The final waste disposal amount payable by the Hirer will consist of:

(a) The applicable third-party disposal facility charges, including weighbridge, landfill, waste classification and item-specific fees.

(b) An additional 15% administration and processing fee calculated on those disposal facility charges.

(c) GST, where applicable.

(d) Any other charges arising under these Terms and Conditions, including additional handling, contamination or prohibited waste charges.

Example – Waste Disposal Calculation

Where the applicable disposal facility charge is $400.00:

  • Disposal facility charge: $400.00
  • Administration and processing fee (15%): $60.00
  • Subtotal: $460.00
  • Plus any additional GST applicable under the relevant tax treatment.

The above example is illustrative only and does not represent a fixed disposal price.

Final charges will depend on waste type, weighbridge weight, applicable facility rates and the prevailing charging arrangements.

7. SKIP PLACEMENT

7.1 WW will determine the final Bin position based on safe delivery and collection access.

7.2 Where the Hirer requests placement of a Bin within private property, the Hirer must identify any known hazards, underground services, unsuitable surfaces or access restrictions.

7.3 The Hirer must ensure the Skip Bin does not create a hazard to pedestrians, vehicles or public access areas.

7.4 The Bin must remain in its delivery position with unobstructed access for collection.

The Hirer must not move or permit the Bin to be moved without WW’s prior approval.

If the Bin is moved to a location preventing safe collection, the Hirer may be liable for:

(a) Additional retrieval costs.

(b) Extended hire fees arising from the delay.

(c) An additional relocation fee of $100.00.

The Hirer may also be responsible for reasonable costs incurred in returning the Bin to a safe collection position.

  • Steep gradients.
  • Low overhead obstructions.
  • Restricted manoeuvring space.
  • Unstable surfaces.
  • Aggressive animals.
  • Persons behaving in a threatening manner.

9. ALLOWABLE WASTE

Additional charges may apply where prohibited or unsuitable materials are found in the Bin.

11.1 Skip Bins must only be filled to the top rim, referred to as the “water level”. Overfilling is not permitted.

(a) Materials loaded above the rim may be removed and left on site.

(b) The Hirer may be required to repack the Bin to a safe and compliant level. A $100.00 fee may apply where this requires additional attendance or handling.

(c) Alternatively, an additional Bin may be supplied and charged at WW’s applicable hire rate.

12. DAMAGE AND RESPONSIBILITY

12.1 The Hirer is responsible for loss or damage to WW’s Bins caused by the Hirer or persons acting under the Hirer’s direction while the equipment is in the Hirer’s care.

12.2 Burning waste in a Bin is strictly prohibited. The Hirer will be responsible for reasonable cleaning, repair or replacement costs resulting from such damage.

13.2 Where a Bin has been dispatched or delivered and is subsequently cancelled or cannot be placed because of unsafe or inaccessible conditions attributable to the Hirer, WW may recover the reasonable cost of services already performed.

13.3 WW reserves the right to charge reasonable cleaning fees for contamination or excessive deposits of paint, plaster, granosite, wet concrete or other materials that damage or disfigure the Bin.

13.4 Where a Bin is used or relocated without approval, WW may arrange recovery or removal of the equipment and recover reasonable associated expenses, subject to lawful access requirements.

13.6 Where safe or clear access is unavailable and the driver is required to wait, additional waiting charges may apply.

13.7 WW will take reasonable care when delivering and collecting Bins. The Hirer is responsible for damage attributable to the Hirer’s failure to disclose hazards or provide agreed safe access, except to the extent caused by WW’s negligence.

13.8 Additional hire charges may apply where collection cannot occur because of weather-related site conditions, subject to the circumstances and applicable law.

13.9 The Hirer may be responsible for damage to WW’s truck tyres resulting from the Hirer directing a driver over known hazardous objects or surfaces, except to the extent caused by WW’s negligence.

13.10 Additional Charges May Include:

14.2 WW attends the nominated site but cannot safely access or retrieve the Bin because of conditions attributable to the Hirer.

Reasonable additional attendance, waiting or collection charges may apply in accordance with Clause 13.

Where the Hirer fails to make payment in accordance with the agreed payment terms, WW reserves the right, subject to applicable law, to recover amounts properly due under this Agreement.

These may include:

(c) Reasonable debt recovery costs and legal expenses incurred in recovering outstanding amounts, to the extent recoverable under applicable law.

WW will not charge interest during an agreed payment period where payment is made on time.

16. LIABILITY

16.1 The Hirer is responsible for providing accurate information about site conditions, access, surfaces and underground services that may be affected by delivery or collection.

16.2 WW will take reasonable care when processing payments through third-party payment gateways but is not responsible for failures caused solely by independent third-party systems, except where liability cannot lawfully be excluded.

16.3 To the extent permitted by law, WW excludes liability for indirect or consequential loss, including lost profits, revenue or contracts.

16.4 Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law or any other law that cannot lawfully be excluded.

16.5 The Hirer acknowledges that skip delivery vehicles are heavy vehicles and may cause damage to unsuitable driveways, paving, paths, lawns, underground services, irrigation systems or other surfaces.

Where the Hirer requests placement on private property, the Hirer must disclose known hazards and accepts responsibility for damage attributable to unsafe site conditions or instructions supplied by the Hirer, except to the extent caused by WW’s negligence or breach of applicable law.
